Hmm. I'd say they are STILL on the fence about the issue ..........
Although the subtle meaning is impressive. by saying simply "Smoking Kills" it has an implication that an act can kill you, not the product being sold. Thus, I guarantee that someone would still sue because the warning was not implicit.
Advertising is all in the wording.
To make it clearer and unbreakable, you'd have to make it say "This product will kill you."
Of course, this is all academic here in the US. As long as the government still makes money taxing the damn things, you'll never see anything like that picture happen here. They won't cut off a source of money to themselves.
